Overview

This page sets out the terms on which Oliver Lardner ("we", "us", "our") offers products for sale through the online store at this website (the "Store"). By browsing or purchasing from the Store you ("you", "your") agree to these Terms of Service ("Terms").

If you do not agree to these Terms, please do not use the Store.

These Terms are governed by Australian law, including the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) ("ACL"). Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy conferred on you by the ACL or any other applicable law that cannot be lawfully excluded.

1. Eligibility

By using the Store you confirm that you are at least 18 years of age, or are using the Store with the supervision and consent of a parent or guardian. You agree not to use the Store for any unlawful purpose, nor to interfere with its operation or security.

2. Products and pricing

  • All prices are listed in Australian Dollars (AUD) and, where applicable, include GST.
  • We do our best to display products and colours accurately, but small variations between on-screen images and the actual item — particularly for handmade and original works — are normal and do not constitute a defect.
  • Stock is limited. Unique works are one-of-a-kind. Where a product is shown as "Sold out" we cannot guarantee availability.
  • We may modify, withdraw or discontinue any product at any time. We are not liable to you or to any third party for any such modification, withdrawal or discontinuation, except as required by the ACL.

3. Orders and payment

  • Payment is processed by Stripe. We do not hold your card details.
  • Placing an order is an offer by you to purchase the items at the listed price. Your order is accepted only when we send you a confirmation email. We may decline or cancel any order at our discretion, in which case any payment already taken will be refunded in full.
  • We reserve the right to limit quantities, refuse or cancel orders that appear to be placed by dealers or resellers, or that we suspect to be fraudulent.

4. Shipping

  • Shipping is calculated at checkout based on the destination.
  • Larger artworks and bulky items may require freight quoted separately. In those cases we will contact you to confirm the arrangements and any additional cost before processing the order.
  • We are not responsible for delays caused by carriers, customs or events outside our reasonable control.
  • Once an order has been placed, we are unable to change the shipping address. Please double-check your details before completing checkout.

5. International orders

International customs duties, import taxes and other fees are not included in the product or shipping price and are the responsibility of the customer. Please check with your country's customs authority before ordering.

6. Returns, exchanges and refunds

As a small studio, all sales are final and we do not offer change-of-mind returns or exchanges.

This does not affect your rights under the Australian Consumer Law. Under the ACL, our goods come with guarantees that cannot be excluded. You are entitled to a replacement or refund for a major failure (for example, the product is significantly different from its description, has a serious safety problem, or has a defect you would not have bought it with had you known about it) and to compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.

If your order arrives damaged or there is a problem, please contact us via the contact form within 7 days of delivery with photos and your order number so we can resolve it.

7. Intellectual property

All images, text, designs and artworks shown on the Store are the property of Oliver Lardner (or used with permission) and are protected by copyright. Purchase of a physical work does not transfer any reproduction or copyright rights. You may not reproduce, copy, resell or otherwise commercially exploit any content from the Store without our prior written permission.

8. Acceptable use

You agree not to:

  • Use the Store for any unlawful purpose;
  • Attempt to interfere with or compromise the security or integrity of the Store;
  • Use automated systems (bots, scrapers, crawlers) to access the Store without our written consent;
  • Submit false, misleading or fraudulent information.

We may suspend or terminate your access to the Store at any time without notice if we reasonably believe you have breached these Terms.

9. Disclaimer and limitation of liability

To the maximum extent permitted by law, and subject always to the consumer guarantees under the ACL:

  • The Store and the products are provided on an "as is" basis.
  • We make no warranties beyond those required by the ACL.
  • We are not liable for any indirect, incidental, consequential, special or punitive loss or damage arising from your use of the Store or any product purchased through it.
  • Our maximum liability for any product (other than as required by the ACL) is the amount you paid for that product.

10. Third-party links

The Store may link to external websites. We are not responsible for the content, accuracy or practices of those sites.

11. Privacy

Your personal information is handled in accordance with our Privacy Policy.

12. Errors and inaccuracies

Occasionally information on the Store may contain typographical errors, inaccuracies or omissions relating to descriptions, pricing, promotions, shipping or availability. We reserve the right to correct any such errors, and to change information or cancel orders if any information on the Store is inaccurate at any time without prior notice (including after you have submitted your order). If an order is cancelled for this reason, any payment already taken will be refunded in full.

13. Changes to these Terms

We may update these Terms from time to time by posting an updated version on this page. The "Last updated" date will reflect when the most recent changes were made. Your continued use of the Store after any change constitutes acceptance of the updated Terms.

14. Governing law

These Terms are governed by the laws of Victoria, Australia. The parties submit to the exclusive jurisdiction of the courts of Victoria for any dispute arising out of or in connection with these Terms.
